These general agreements and conditions apply to the ESSENTRICS NL store, events, workshops and Fitness Breaks organized by ESSENTRICS NL and all purchase and sales agreements entered into by ESSENTRICS NL and its customers.

ESSENTRICS NL may from time to time amend these general terms and conditions. The most recent version of the terms and conditions is always the version that is applicable and is always available at the website www.essentrics-store.eu.

Offer, Prices and Payment
The offer contains a complete and accurate description of the products and/or services being offered. The description is sufficiently detailed to enable the consumer to make a proper assessment of the offer. ESSENTRICS NL is not bound by obvious errors or mistakes in the offer.
ESSENTRICS NL reserves the right to change the prices. The currently applicable rates are always mentioned on the website
If an offer is subject to a limited period of validity or is made subject to conditions, this will be explicitly mentioned in the offer.
Every offer will contain such information that makes it clear to the consumer what rights and obligations are involved in accepting the offer.
Prices include taxes (9% or 21% VAT)
Prices exclude costs of delivery
Our Payment methods are Ideal, Bancontact, Mastercard, Visa and PayPal.
We are not responsible for credit card conversion fees, foreign fees or banking fees. Please contact your bank directly with questions regarding these fees.

All offers are without any obligations and valid based on availability. In case a product is temporarily unavailable or out of stock the consumer will be informed within seven (7) days, and the contract will remain valid. In case the product is no longer available the consumer will be informed within thirty (30) days, the contract will cease to be valid and the price the consumer has paid will be fully reimbursed.

All orders need to be, fully or, if applicable, partially paid before delivery. As soon as ESSENTRICS NL has received payment the order will be processed.

Shipping policy and delivery
A valid shipping address must be provided at the time of the purchase. If the shipping address provided at the time of the purchase is incorrect and/or a package is unclaimed, additional shipping fees will apply. All customers who have a package that must be re-delivered will be charged additional shipping fees.

Shipping and handling fee of the order as a whole, per region:
– Within the Netherlands – € 3,90
– Within Europe Region 1 (Belgium, Luxembourg, Denmark (excl. Faroe Islands & Greenland), Germany, France (incl. Corsica and Monaco), Italy (excl. San Marino and Vatican City), Austria, Spain (incl. Balearic Islands, excl. Canary Islands), United Kingdom (excl. Gibraltar and Channel Islands), Sweden) – € 10,60
– Within Europe Region 2 (Bulgaria, Estonia, Finland, Hungary, Ireland, Croatia, Latvia, Lithuania, Poland, Portugal (incl. Azores and Madeira), Romania, Slovenia, Slovakia, Czech Republic) – € 13,95
ESSENTRICS NL is in no way liable if delivery occurs at a later date. Exceeding the delivery time and/or exceeding the period of thirty (30) days after placing the order shall not automatically place ESSENTRICS NL in default.

Return Policy
When purchasing products, a consumer has the possibility of dissolving the contract, without giving reasons, during a period of seven (7) days. This period commences on the day after the product was received by – or on behalf of – the consumer.
Before returning any product, please contact europe@essentrics.com for proper return and refund procedures.
We will refund your product within thirty (30) days of the shipping date. The product must be in its original packaging and unopened.
A proof of purchase must be provided for every refund (invoice, transaction ID, mailing label, etc). After seven (7) days, we reserve the right to refuse any refund.
Please note that we are unable to exchange items.
ESSENTRICS NL will refund the amount of the order, minus the shipping and handling fees, within 7-14 business days upon having received the returned products.
It is the client’s responsibility to pay for the return shipping and handling fee.
Essentrics NL will only pay the return shipping and handling fee if the product is defective, incorrect or a result of our error.

Privacy Policy
We understand everyone’s concern for privacy. That’s why your personal information is used strictly for processing your order.
We do not share your personal information.
All personal data provided by the consumer to ESSENTRICS NL is only kept insofar as is necessary in order to fulfil the aims for which it was obtained, such as processing the consumer’s order and informing the consumer about ESSENTRICS NL and the ESSENTRICS NL’s products and / or services.
Personal details are not used for redistribution without the consumer’s prior permission.
If the consumer does not want to receive communications from ESSENTRICS NL, he or she may communicate this to us by sending an e-mail to europe@essentrics.com.

About ordering from a third-party seller
Third-party sellers are parties like Bol.com and Champneys Spa Resort.
ESSENTRICS NL is not directly involved in the completion of sales arranged with third-party sellers. Need to contact the third-party seller directly for the following issues:
– to check on order or shipment status;
– to schedule or reschedule services;
– to cancel an order and receive a refund;
– to return an order.

Liability
In every case, every liability ESSENTRICS NL has towards the consumer is limited to the full amount of the relevant invoice that the consumer is holding ESSENTRICS NL accountable for.
ESSENTRICS NL is not liable to any person for any misunderstandings, injuries, delays, or improperly executed orders and announcements that may arise from the use of the internet or other forms of communication between ESSENTRICS NL and the consumer, or between ESSENTRICS NL and third parties.
ESSENTRICS NL, its staff and products are explicitly excluded from all liability relating to damages of whatever nature, whether direct or indirect, among which company damage, consequence damage, damage to property or persons has occurred.
Attending ESSENTRICS classes, events, workshops or Fitness breaks are at the participants own risk. ESSENTRICS NL accepts no liability whatsoever for physical injury, loss or damage relating to a participant attending ESSENTRICS classes, events, workshops, Fitness breaks or by the use of its products.
ESSENTRICS NL manages and maintains this website from the Netherlands and therefore does not guarantee that the information provided on its website is always completely appropriate for use in other countries.

ESSENTRICS NL works with certified ESSENTRICS teachers and always ensures high-quality ESSENTRICS classes, events, workshops and Fitness breaks. Even so, participants to any form of physical exercise always run the risk of receiving an injury.
Participants understand that participation in all classes, events, workshops and Fitness breaks are entirely at their own risk and any loss, damage, injury or any other mishap will not be the responsibility of ESSENTRICS NL or the ESSENTRICS teacher involved.
We provide the following guidelines for reducing the risk of an injury:
Always consult a doctor before participating in an ESSENTRICS class if you are not sure that you are completely healthy or if you are pregnant.
Always inform your ESSENTRICS teacher if you have an injury or any other physical inconvenience, before starting the ESSENTRICS class.
Always listen to and follow the instructions of the ESSENTRICS teacher.
Workout carefully and respect your physical limitations. Do not perform any exercises that are painful.
Ask questions if you do not understand an exercise.

Workshops and Fitness Breaks
By participating in an event, a workshop or a Fitness break organized by ESSENTRICS NL the participant accepts the applicability of the general terms and conditions.

A participant may participate in a workshop or a Fitness break after he or she has registered for it with ESSENTRICS NL in advance and paid the registration fee or the price. A place in an event, workshop or Fitness break is guaranteed after ESSENTRICS NL has received payment of the registration fee or the deposit (50% of the retreat price), whichever applies.
For some events, workshops and Fitness breaks, an early bird offer applies. This offer applies until the date specified on the website. After this date the normal offer, which is also specified on the website, applies without exception.
Payments for an event, workshop or Fitness break must be made before the event, workshop or Fitness break is held. Payments can be made by a direct bank transfer, Ideal or credit card (Mastercard or Visa), whichever applies.

In the event of participation in a Fitness break, a place in the Fitness break is guaranteed after ESSENTRICS NL has received full payment or the payment of the deposit (50% of the Fitness break price). The balance must be paid six (6) weeks before the start of the Fitness break is scheduled at the latest. If a Fitness break booking is made within six (6) weeks of departure, full payment is required at the time of booking. If full payment is not received, we reserve the right to cancel the booking and cancellation charges (the handling fee of €15) will apply.

In case the participant chooses to pay a deposit (50% of the Fitness break price) an additional handling fee of €15,- will be added to the second payment. ESSENTRICS NL will send the participant a timely reminder to pay the remaining balance of the Fitness break price.

Minors are not permitted to make a booking with ESSENTRICS NL. Bookings made under a false name or address are not permitted either.

Cancellation of events, workshops and Fitness break registration
Until one (1) month before the scheduled event or workshop date, the participant may cancel his or her registration free of charge (unless mentioned otherwise). This can be done by an email sent to europe@essentrics.com.
Until seven (7) days before the scheduled event or workshop date, the participant may cancel his or her registration, in which case the registration fee is refunded, less a handling fee of €25.
If the participant cancels his or her registration later than seven (7) days before the scheduled workshop, the registration fee is not refunded.

Cancellation of participation in a Fitness break
Any participation in a scheduled Fitness break may be cancelled only in writing. This can be done by sending an email to europe@essentrics.com.
The cancellation will take effect from the day the written notification is received. If the written cancellation is received by us outside office hours, then the next day will be the cancellation date.

The following scale charges will be payable depending on when the notification of cancellation is received:

If cancelled up to eight (8) weeks before the trip: 10% of the price;

If cancelled up to six (6) weeks before the trip: 35% of the price;

If cancelled up to four (4) weeks before the trip: 50% of the price;

If cancelled up to fourteen (14) days before the trip: 75% of the price;

For cancellation from eight (8) days to thirteen (13) days before the trip: 90% of the price;

If the Fitness break participant cancels his or her registration later than seven (7) days before the start of the retreat, the price already paid is not refunded.

We would strongly recommend that participants take out full insurance, which in most cases includes cover for loss of the deposit and cancellation fees under certain circumstances.

If it turns out at the location of the Fitness break that the participant cannot participate in the Fitness break for whatever reason, the price already paid is not refunded.

The passenger is responsible for his/her own actions and the actions of all members of his/her booking party. If it is believed that any member of the party has caused offence, distress, danger, damage or annoyance to any other guests, staff or property, ESSENTRICS NL may terminate the booking and the Fitness break with immediate effect. Thereafter, we will not take responsibility for any party member; our contract with the participant will be terminated and the full cost of the holiday will be forfeited without any compensation or refund of expenses incurred by the passenger.

ESSENTRICS NL reserves the right to cancel a scheduled class, event, workshop or Fitness break if there are insufficient participants or in the event of force majeure (including illness of the relevant teacher). In this case, the registration fee already paid is fully refunded.

Participants are deemed to have read and understood these general terms and conditions prior to booking. Participants agree to these terms and conditions when making a booking.

Governing Law and Dispute Settlement
The general terms and conditions are exclusively governed by Dutch law.
Any disputes relating to the general terms and conditions, attending an ESSENTRICS class, events, workshops or Fitness Breaks organized by ESSENTRICS NL are settled exclusively by the competent court in Amsterdam or any higher court.
